  1. INTRODUCTION & LEGAL INFORMATION

We want your browsing on the webpage (hereafter the “Web”) to be as safe, transparent and comfortable as possible. We set out below, for your convenience, all the legal information regarding the use of our Web.

We invite all users (hereafter the “User”) to read these terms and conditions carefully (hereafter the “Terms & Conditions”), before using the OCEAN Web.

Observance of and compliance with these Terms & Conditions will be a requirement for anyone to access, browse or use the Web. If you do not accept these terms, please do not use this Web.

On using the Web, therefore, you undertake to use the services and contents in accordance with current legislation and these Terms & Conditions, and you acknowledge and accept that your use of the contents and/or services offered by its proprietor will be under your own exclusive risk and/or liability.

  1. PURPOSE AND AMBIT OF THE WEB

These Terms & Conditions govern access to, browsing and use of the Web. However, the use of some of the services offered will also be subject, where applicable, to the particular conditions provided in each case.

The Web services are provided for a limited duration at the time when the User is connected to it or to one of the services accessed through it.

OCEAN reserves the right, at any time and without notice, to alter or update the contents of these Terms & Conditions and, in general, of all the elements integrated into the design and configuration of its Web.

  1. SERVICE OFFERED

The Web includes information addressed to the general public regarding the services offered by OCEAN. This Web is free and, through it, OCEAN makes available to all its users a corporate communication channel through which it is possible to:

  • Send requests for information through the “Contact us” section of the Web. Depending on the information requested and the user’s geographical location, you may be contacted by people associated with companies operating under the OCEAN trading names (Nutreco Animal Nutrition Iberia S.A.U., Piensos Nanfor, S.A., Piensos Nanpro, S.A.).
  • Confirm and make entries for events.
  • Subscribe to the newsletter.
  • Send us your CV through the “Work with us” section.
  • Find our contact data and the location of our offices.

For all this, the User needs to use a browser to access the Web, with no need to open a session in order to see the contents. Then, before accessing the contents, the User needs to accept these Terms & Conditions.

These Terms & Conditions regulate access to, browsing and use of the Web and in them we give information on the rights and obligations of Users in relation to the contents shown on the Web, the logos and trademarks used and the liabilities that may arise from such use.

Accessing, browsing and using the Web implies express and unreserved acceptance of all sections of these Terms & Conditions, which are as valid and effective as any written, signed contract. Without prejudice to the above, OCEAN reserves the right to alter the presentation, configuration and content of the Web, as well as these Terms & Conditions, we therefore recommend checking them on a regular basis.

Any change of this kind will be published clearly on the Web, indicating the date of the most recent update at the foot of the document. If you continue using the services provided on the Web when the Terms & Conditions have been altered, it will be understood that you accept the changes.

  1. INTELLECTUAL & INDUSTRIAL PROPERTY RIGHTS

OCEAN is the proprietor of, or holds the relevant licences for, the intellectual, industrial and image rights and any other analogous rights over the Web and all the contents offered on it, including, for example but not limited to, photographs, illustrations, logos, trademarks, graphics, designs, interfaces or any other information or content included there.

In no case can it be understood that the User’s access to, browsing and use of the Web implies any waiver, transfer, licence or total or partial grant of any intellectual property right by OCEAN.

As User, you have only the right to non-exclusive use, in a strictly professional ambit and only for the purpose of being able to benefit from the various functionalities of the Web in accordance with these Terms & Conditions. The reproduction, distribution, public communication, transformation or any other form of use of any of the protected elements is expressly prohibited, except where expressly authorised by OCEAN. Any other use of the Web content is also strictly prohibited, with the sole exception of use on a strictly domestic scale.

Unauthorised use of information contained in the Web and any other kind of infringement of OCEAN’s intellectual or industrial property rights will give rise to the legally established liabilities.

  1. LINKS FROM OTHER WEBPAGES

OCEAN does not authorise the establishment of any link to this Web from other webpages that contain materials, information or contents that are illicit, unlawful, degrading, obscene and, in general, that contravene the law, morality or public order, or generally accepted social standards.

OCEAN has neither the powers nor the human and technical means to be aware of, control or approve of all the information, contents, products or services supplied by other websites that have links established which lead to the Web.

OCEAN accepts no kind of liability for any aspect relating to webpages that establish such links leading to this Web; specifically, for example but not limited to, their functioning, access, data, information, files, quality and the reliability of their products and services, their own links and/or any part of their contents, in general.

In any case, OCEAN reserves the right to prohibit links to the Web and to demand their removal when they do not meet the conditions defined in this section.

  1. RULES ON THE USE OF THE WEB

This Web can be useful for the users’ own propositions in undertaking their functions in the professional field and OCEAN can use it as a tool for making corporate information available to the members.

All users must provide true information to complete their profile. In the event that the user provides information that is not in line with reality, OCEAN will not be responsible for the effects that such conduct may cause.

In any case, OCEAN reserves the right to edit or remove any information provided by the User through the Web.

It is not permitted and, therefore, any consequences will be the exclusive responsibility of each User, to access or use the Web for unlawful or unauthorised purposes, whether or not with financial aims. In particular, without this being comprehensive, the following are prohibited:

  1. Using the Web in any way that could cause damage, interruptions, inefficiencies or defects in its functioning or in third party devices;
  2. Using the Web for the transmission, installation or publication of any virus, Trojan horse, worm, logic bomb, malicious software or other damaging programmes or files;
  3. Using the Web to transmit material for advertising or promotional purposes, including spam, electronic and similar chain letters;
  4. Using the Web in any way that constitutes an infringement of the rights of OCEAN or of any third party;
  5. Using the Web to transmit or publish any material that is defamatory, offensive, racist, degrading or of a threatening nature, or that could disturb, prejudice or simply affect any other person;
  6. Using the Web to collect personal data of other Users;
  7. Using the Web illegally, against the principles of good faith, morality and/or public order;
  8. Unauthorised access to any section of the Web, to other systems or networks connected to it, any OCEAN server or the services offered through the Web, by means of piracy or falsification, the extraction of passwords or any other unlawful means;
  9. Carrying out any action that causes a disproportionate or unnecessary saturation of the Web infrastructure or OCEAN’s systems or networks, and the systems and networks connected to the Web itself.

The User’s non-compliance with any of the above obligations may result in OCEAN adopting the appropriate actions, supported by the Law, in the exercise of its rights and obligations.

OCEAN may even prevent access to the Web, or the possibility of participating in spaces prepared in it, for Users who fail to comply with these conditions, with no possibility of any compensation for the loss and damages caused.

  1. LIABILITIES AND GUARANTEES.

OCEAN cannot guarantee the reliability, usefulness or truth of absolutely all the information contained in the Web, nor the usefulness or truth of contents made available to Users through it.

In consequence, OCEAN does not guarantee and will not be liable for:

  1. the continuity of Web contents;
  2. the absence of errors in those contents;
  3. the absence of viruses, Trojan horses, worms, logic bombs and/or other malicious or technologically damaging components in the Web or in its server;
  4. the invulnerability of the Web and/or the impossibility of breaching the security measures adopted in it;
  5. the lack of usefulness or performance by contents on the Web;
  6. faults on the Web caused by any kind of attack on its servers or those of third party providers of OCEAN services, also technical or security faults in the systems of any of the aforesaid providers where these impede the Web functions;
  7. any technical fault of any kind which hampers, delays or impedes the correct functioning of the Web;
  8. loss and damages caused, to himself or to a third party, by anyone infringing the conditions, rules and instructions that OCEAN establishes in the Web or through a breach of the security systems.

However, OCEAN declares that it has adopted all the necessary measures, within its possibilities and the state of the art, to guarantee the functioning of the Web and to reduce errors in the system to the minimum, both from the technical viewpoint and for contents published on the Web.

OCEAN will not be responsible for the truth, integrity or actuality of information published on the Web which comes from outside sources, nor for the contents of other platforms to which there are links from the Web.

OCEAN reserves the right to suspend, alter, restrict or interrupt, whether temporarily or permanently, access to, browsing, use, the hosting and/or downloading of content and/or use of the Web services, with or without prior notice, for Users who contravene any of the provisions detailed in these Terms & Conditions, with no possibility of compensation being claimed on this account.

If the User should become aware of the publication of any inaccurate, out-of-date or false data or the existence of any content that is illicit, unlawful, contrary to law or could be an infringement of intellectual or industrial property rights, the regulations applicable in matters of personal data protection and/or any other right, this should be notified immediately to OCEAN so that it can proceed to the adoption of the appropriate measures.

  1. CONFIDENTIALITY AND DATA PROTECTION

In accordance with REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereafter “GDPR”) and Organic Act 3/2018, of 5 December, on Personal Data Protection and guarantee of digital rights (hereafter “LOPDGDD”), OCEAN, as the Controller of processing, will process all the personal data supplied during the use of the Web in accordance with its Privacy Policy. Certain Web functions also depend on the use of Cookies, as is explained in the Cookies Policy.

Whenever the User provides personal data, that User will be solely responsible for the truth and accuracy of those data and must therefore communicate to OCEAN any updating of the data as soon as possible.

  1. SAFEGUARDING CLAUSE

If any clause included in these Terms & Conditions should be declared totally or partially null or ineffective, that nullity or ineffectiveness will only affect that provision or the part of it that is null or ineffective, these Terms & Conditions remaining effective in all the rest, with that provision being considered totally or partially as not included.

  1. LEGISLATION APPLICABLE AND JURISDICTION

These Terms & Conditions are governed by Spanish law. The parties expressly submit themselves, for the settlement of conflicts and with express waiver of any other forum, to the Courts and Tribunals of Madrid, unless there is some contrary legal imperative, in which case, its content will govern.

To file any claim regarding the use of our services, you can write to the e-mail address or postal address given at the beginning. OCEAN undertakes at all times to seek an amicable solution in the event of any conflict.
